“Cybercrime is defined as an illegal or criminal activity which is conducted by means of computer or internet”

What is Cybercrime Law in Pakistan:

The lower House of Pakistan, the National Assembly has passed the Cybercrime law which is called the Prevention of Electronic Crime Act on 11th of August, 2016

Prevention of Electronic Crimes Act 2016:

According to Act, the basic purpose of legislation is, “to prevent unauthorized acts with respect to information system and provided for relative offenses as well as mechanism for their investigation, prosecution, trial, and international corporation”

The Act is comprised of following electronic offenses such as spamming, authorized access, transmission, copying or interference in an information system of data. Strict penalties are set for these electronic crimes particularly if they are involved information systems or data connection to critical infrastructure.

Under Section 18 (1) of this law, states that

Whoever intentionally or publicly exhibit, display or transmits any information through an information system, which he knows to be false, and intimidates or harm the natural person, shall be punished with imprisonment for a term which may extend to three years or with fine which may extend to one million rupees or both.

Section 19 of the Act,

This section is deals against the modesty of a natural person or a minor, “whoever intentionally or publicly exhibits, display or transmits any information, a photograph of the face of a natural person or any sexually explicit image or video, shall be punished with imprisonment for a term of 5 years or with fine which may extend to five million rupees or both.

Whoever intentionally makes, produces, transmits, distributes or procure the online child pornography, shall be punished with imprisonment for a term of seven years or fine which may be extended to five million rupees of both.

Section 34 of the Act

Under this section the Pakistan Telecommunication Authority grants the permission or power to remove or block or issue directions for removal or blocking of access to information to any information system, if it is considers it necessary in the interest of the glory of Islam or the integrity, security or defense of Pakistan or any part therefore, public order, decency or morality, or in relation to contempt of court or commission, incitement to an offence under this Act (Prevention of Electronic Crimes Act, 2016)
